1. Introduction
Welcome to Nexion’s 360° Leadership Evaluation Platform. By accessing and using our services, you agree to comply with these Terms & Conditions. If you do not agree with any part of these terms, you must not use this platform.
2. Definitions
- "Platform" refers to our 360° leadership evaluation system.
- "Leader" refers to an individual being evaluated.
- "Rater" refers to supervisors, peers, direct reports, or external evaluators.
- "Company Admin" refers to the organization that mandates the evaluations.
- "We" or "Us" refers to Nexion Consulting, Switzerland
- "You" refers to any user of the platform.
3. Eligibility & User Roles
3.1 Leaders
- Must be invited by their company to participate.
- Must provide accurate personal data.
- Must agree to these Terms & Conditions before using the platform.
- May invite raters to participate in the evaluation.
- May access their own evaluation reports.
3.2 Raters
- Are invited by Leaders to provide feedback.
- Can opt out of participation at any time.
- Will only see the Leader’s first and last name and the evaluation course name.
- Provide anonymous feedback (except for Supervisors, who are informed that their responses are not anonymous).
3.3 Company Admins
- Provide Leader data to initiate evaluations.
- Are responsible for ensuring Leaders and Raters are informed of their rights.
- May access aggregated evaluation results for organizational insights.
4. Data Processing & Privacy
Personal data is processed in accordance with our Privacy Policy.
5. User Responsibilities
- Provide truthful and accurate information.
- Use the platform only for legitimate evaluation purposes.
- Not attempt to access or misuse other users' data.
6. Platform Access & Availability
- We strive for 99.9% uptime, but we do not guarantee uninterrupted access.
- We may suspend or restrict access for maintenance, security reasons, or legal compliance.
- We reserve the right to modify or discontinue the platform at any time.
7. Intellectual Property
All software, content, and materials on the platform are the property of Nexion Consulting. Users may not copy, distribute, or modify any part of the platform without permission.
8. Limitation of Liability
We are not liable for any decisions made based on the evaluation reports. We do not guarantee specific results or improvements from using the platform. We are not responsible for unauthorized access due to user negligence.
9. Governing Law
These Terms & Conditions are governed by Swiss law. Any disputes shall be resolved in the courts of Lausanne, Switzerland.
10. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. Users will be notified of major updates via email or website notification.
